About Us and Our Services

Achieve Test Prep is a prep course company. We provide services that college students use to prepare for and pass their college course requirements. We are not a college or school. Our services include, but are not limited to prep courses for Credit by Exam tests, prep courses for entrance and exit exams, access to our knowledge base of commonly asked questions and answers about core major courses, as well as on-demand tutoring by appointment. Although colleges and schools may accept credits earned through Credit By Exam, all credits are applied by those colleges and schools per their rules, and not from us.

Access to Services

As long as your payments are paid as scheduled, you will have access to all Achieve Test Prep services during the term of your Membership. The number of prep courses you can take simultaneously will depend on your Membership term. The details are outlined in the table below:

Past due or otherwise unpaid accounts, whether due to declined credit card charges, customer chargebacks of scheduled credit card payments, charges not approved due to max charge limits, or otherwise, will result in suspended access to Achieve Test Prep services, unless and until the past due charges are paid. Your term of Membership will not be extended if your access is suspended for all or part of the term.
You may NOT share or in any other manner allow any person to use your access to services we provide. You agree that if you violate this requirement, you will be agreeing to pay the then-applicable monthly payment amount for each person with whom you share or allow to use your access for each month in which such access was shared or used, and you agree to pay such amount without need for any request or demand for such payment from us. A failure to pay such amounts will cause your account to be an unpaid account even if all other amounts due have been paid and will result in suspension of your access as set forth in the preceding paragraph.

Automatic Payments

1. Recurring payments will automatically be processed based on your chosen payment frequency.
   1. Monthly payments will be processed on the same day each month.
   2. Annual payments will be processed on the same day each year, and in the second and following years will convert to a monthly payment frequency without the annual payment savings.
   3. If you would like your annual renewal to be billed annually and receive the discounted rate, please submit a request by email or postal mail using the contact information at the bottom of these terms.
2. Upgrades and downgrades will automatically renew on the same day each month.

Exam Fees

1. Achieve Test Prep will reimburse exam fees of up to $150 once for each completed prep course provided that all terms and conditions below are met:
   1. You must have completed at least 85% of all assignments that were assigned by the instructor for the related prep course.
   2. You attended at least 85% of the scheduled lessons for the related prep course.
   3. You have paid at least $500 toward your Membership.

Upgrades and Downgrades

1. You may upgrade your services at any time.
2. You may downgrade your services once you have paid the balance due for your registered and completed prep courses.
3. A $99 contract modification fee applies to all downgrades.
4. You may make a one-time hardship downgrade to temporarily lower your recurring payment. Hardship downgrades are applied with the following schedule and terms:
   1. First 3 months, you will be billed $39 per month and have no access to Achieve Test Prep solutions.
   2. In months 4 through 6, you will be billed 50% of your original recurring payments and given access to one prep course.
   3. In month 7 or any earlier time that you choose, your original recurring payments will restart and provide full access to your prep courses if your account has no balance due.
   4. During the time your account is in hardship downgrade status, you will not be placed in the billing collections process. However, if you do not make your monthly payment as outlined in steps 4a, 4b and 4c, your account will be placed in collections.

Cancellation of Membership

• Within 24 hours of purchase
  1. You may cancel your services for a full refund (does not include Bridge Plans) if you do so within 24 hours of your purchase. To do so, contact our Customer Success team.
  2. Notwithstanding the above, however, Bridge Plans are non-refundable.
• After 24 hours of purchase
  1. You are committing to register and pay for at least one prep course.
  2. You are agreeing to pay for all prep course(s) of which you have registered for or completed, plus 20% of the remaining balance due for your program. Contact our Customer Success team for the exact amount.
     • Your remaining balance due is calculated based on the program you have in place at the time of your last completed course.
  3. You may stop future scheduled payments once your payment obligations have been fulfilled. To do so, contact our Customer Success team.
  4. Once you stop future scheduled payments, recurring payments will be turned off within 5 business days.

Refunds

1. Achieve Test Prep is not responsible for customers who do not use their purchased services. No refunds will be made of any amounts paid to Achieve Test Prep, after the expiration of the 24 hours after purchase period referenced above. In all other circumstances amounts paid to Achieve Test Prep are non-refundable.

Privacy

1. By purchasing your membership, you agree to the foregoing terms and to our privacy policy and promise and confirm that you have actually read the privacy policy, which can be found at https://www.achievetestprep.com/achieve-test-prep-privacy-policy or by clicking on “privacy policy” in the listing of RESOURCES in the footer section, at the bottom of the pages on achievetestprep.com.

Resolving any Disputes

By purchasing your membership, you agree that

1. Your membership and all matters related thereto, including this Agreement are governed by Missouri law
2. Any and all claims or disputes which arise between you and us, of any kind and over any matter, will be resolved through binding arbitration administered by the Global Arbitration Solutions arbitration company under and in accordance with its rules then in effect (www.globalarbitrationsolutions.com) and any action seeking to confirm, challenge, or enforce an award of the arbitrator(s) in the event of an arbitration (and any action if arbitration is for any reason not required despite your agreement to arbitrate), shall be filed and maintained in the Circuit Court for St. Louis County, State of Missouri, which will have exclusive jurisdiction over these matters, that you hereby submit to the jurisdiction of that Court and agree that you won’t ask to transfer or remove the case to any other state, federal or other court, and
3. Any dispute resolution proceedings, whether in arbitration or in court, will be conducted on an individual basis only and not as a class or representative action or as a named or unnamed member in a class, consolidated, representative or private attorney general action.
